Article 1. Members' Rights and Responsibilities

1.1. Purpose
These Terms of Use govern the rights, obligations, and responsibilities of **Lighters Company Co., Ltd** (hereinafter referred to as the "Company") and users of **Kooky** (hereinafter referred to as "Kooky"). This document establishes the rules for service operations, outlines measures for violations, and defines procedures for objections and account restrictions.

1.2. Member Rights

• Members may submit inquiries related to Kooky via hello@kooky.io. However, the Company may decline to respond to:
  • Inquiries unrelated to Kooky’s services.
  • Repetitive or previously answered questions.
  • Unverified rumors, abusive language, or malicious comments.
• The Company does not intervene in disputes between users or compensate for damages due to user negligence. However, if a violation of these Terms is reported, the Company may investigate and take necessary actions.
• Members may appeal any restrictions applied to their account via hello@kooky.io.
• Members must not engage in activities that violate applicable laws or interfere with others’ use of Kooky.
• Violations should be reported via hello@kooky.io.

1.3. Membership Registration and Rejection
The Company may reject membership applications or terminate accounts in the following cases:

• The applicant has previously had their membership permanently suspended.
• The applicant provides false information or uses another person’s identity.
• The applicant is under the age of 14 and has not obtained parental or legal guardian consent.
• The applicant intends to use the service for illegal purposes or to disrupt the normal operation of the Company.
• Any other cases that violate applicable laws or Company policies.

1.4. Account Security and Management

• Users are responsible for maintaining the security of their accounts and must not share or transfer their accounts to third parties.
• If a user detects unauthorized access or account misuse, they must report it to the Company immediately and follow the required security procedures.
• The Company is not responsible for damages resulting from the user's failure to manage their account securely.

Article 2. Restriction on Use of Services

Members may be restricted from using Kooky if they engage in the following prohibited activities:

2.1 Unauthorized Access & Illegal Activities

• Hacking, unauthorized access, or disrupting Kooky’s operations.
• Sharing, promoting, or engaging in illegal activities within Kooky.
• Installing/distributing malware, viruses, or harmful software.
• Stealing or exploiting other users’ data.

2.2 Posting or Sharing Inappropriate Content

• Defamation or harassment targeting individuals or groups.
• Discriminatory content based on race, gender, age, religion, etc.
• Sexually explicit, violent, or threatening content.
• Misleading or fraudulent information.
• Advertising, spam, or excessive commercial content.

2.3 Use of Inappropriate Names

• Profanity, obscene, or offensive names.
• Impersonation of real people, organizations, or Company employees.
• Names suggesting financial transactions or real-money trade.
• Trademark or copyright-infringing names.

2.4 Copyright & Intellectual Property Violations

• Unauthorized sharing or redistribution of Kooky content.
• Uploading pirated movies, music, books, or any copyrighted content.
• Using or distributing copyrighted works without permission.

2.5 Service Disruption & Misuse

• Providing false information to the Company.
• Using Kooky for unauthorized commercial activities.
• Impersonating Kooky staff, artists, or agencies.
• Creating multiple fake accounts to abuse the service.

2.6 Account Violations

• Stealing, selling, or trading accounts.
• Attempting to transfer or lend accounts or in-app items.

2.7 Real Money Transactions & Advertising

• Trading virtual currency (Loovy or Kooky) for real money.
• Advertising or facilitating real-money transactions.

2.8 Exploiting Bugs & Technical Vulnerabilities

• Using service errors to gain unfair advantages.
• Manipulating system vulnerabilities for personal benefit.

2.9 Unfair Kooky Acquisition & Voting Manipulation

• Members must earn Kooky (free virtual currency) through legitimate activities such as in-app engagement or Company-approved surveys.
• Illegally acquired Kooky (via unauthorized scripts, bots, or abuse) may be revoked.
• Votes or scores gained using unfairly acquired Kooky may be invalidated.
• Manipulation of free daily ranking votes through automation, multi-account abuse, or unauthorized methods is prohibited.

2.10 Voluntary Restriction Requests

• Users requesting voluntary restriction due to privacy or security concerns may have their accounts restricted for a specified period.

Article 3. Types of Restrictions on Service Use

The Company enforces restrictions based on the severity of violations:

• Permanent Ban: Issued for severe violations (hacking, fraud, unauthorized account transactions, speculative behavior, real-money trading).
• Temporary Ban: Applied to repeated violations (offensive content, obstruction of service).
• Warning Notification: Given for first-time offenses (offensive usernames, minor policy violations).
• Posting/Sending Restrictions: Offenders may lose posting privileges for up to 30 days for repeated violations.
• Mandatory Name Change: Required for users with inappropriate usernames.
• IP Block: Severe offenders may have IP restrictions applied.
• Voluntary Restriction: Users who request processing limitations will have access restricted as requested.

Article 4. Virtual Currencies (Loovy & Kooky)

4.1. Loovy (Paid Virtual Currency)

• Loovy is a paid virtual currency available for in-app purchases and premium services within Kooky.
• It can be purchased through App Store, Google Play Store, and the official website via Stripe or Xendit.
• Payments follow the policies of Apple, Google, Stripe, and Xendit.
• The Company does not store or process sensitive payment details (credit card numbers, CVV, etc.).
• Refund requests must be submitted via hello@kooky.io and are subject to platform-specific refund policies.
• Loovy does not expire unless specified under promotional terms.
• Loovy cannot be transferred between accounts.
• The Company reserves the right to adjust or modify Loovy's policies at any time.

4.2. Kooky (Free Virtual Currency)

• Kooky is a free virtual currency obtained through in-app activities, participation in surveys for service improvements, or other methods announced within the service.
• The specific earning methods and applicable rules will be provided within the Kooky service.
• Kooky does not expire, unless otherwise stated in special events or promotions.
• Kooky cannot be exchanged for Loovy or real currency.

4.3. Restrictions on Unauthorized Use of Kooky

• Kooky obtained through fraudulent, exploitative, or automated methods is invalid and will be revoked.
• Any votes, scores, or rewards obtained using unauthorized Kooky will be nullified.
• This restriction also applies to the Ranking service's Daily Free Vote feature.
• Fraudulent transactions of Kooky may result in service restrictions, including account suspension.

Article 5. User-Generated Content and Copyrights

5.1. User Posts & Comments

• Users retain the copyright to their posts and comments within Kooky.
• By posting content, users grant the Company a non-exclusive, royalty-free, worldwide, and perpetual license to:
  • Use, store, reproduce, modify, transmit, publicly display, distribute, and edit the content for service operation, enhancement, marketing, and new feature development.
  • Allow content to be featured within search results on Kooky.
  • Use the content for promotional purposes with user consent.
  • Share the content for Company’s IR (Investor Relations) or marketing materials.

5.2. Company-Published User Content

• In some cases, the Company may select and directly publish user-created content within Kooky (e.g., feature highlights, community contributions).
• This content remains under the same licensing terms as user-generated posts.
• The Company must obtain separate user consent before using content for commercial purposes beyond Kooky.

5.3. Content Deletion Requests

• If a user requests deletion of specific content, the Company will review and process the request in compliance with applicable laws and internal policies.

5.4. Service Continuity and Content Ownership

• If a user deletes their account or is permanently restricted, the license granted to the Company remains valid for purposes related to service operation, historical archiving, and promotional use.
• The Company reserves the right to relocate, integrate, or merge user content across different services if necessary for platform improvements.

Article 6. Location-Based Services

6.1. Location Data Collection and Use

• The Company may provide location-based services, such as Kooky Map, which require access to users' precise location data.
• The Company will obtain explicit user consent before collecting or processing any personal location information.
• Location data is used only during active sessions and is not stored or shared with third parties unless required by law or explicitly agreed upon by the user.

6.2. User Control and Consent Withdrawal

• Users may withdraw their consent to location-based services at any time via Service settings.
• Disabling location permissions may limit certain features (e.g., Kooky Map functionality).

6.3. Third-Party Location Data Sharing

• The Company does not share users’ personal location data with third parties without explicit consent, except in cases where legally required.

Article 7. Amendments to Terms of Use

7.1. Notification of Amendments

• The Company will notify users of amendments via service notices or app push notifications.
• Notification timelines depend on the nature of the change:
  • Significant changes affecting user rights and obligations: Notified at least 7 days in advance.
  • Major changes (e.g., paid virtual currency policies, user responsibilities): Notified at least 30 days in advance.
  • Minor amendments or updates applicable only to new users: Effective immediately without prior notice.

7.2. Consent to Amendments

• Users who do not raise objections before the effective date are deemed to have agreed to the changes.

7.3. Explicit Consent for Material Changes

• If amendments introduce new paid features or modify how Loovy/Kooky can be used, the Company may request explicit consent from users where legally required.

7.4. Service Suspension or Termination Notification

• The Company may modify or discontinue all or part of the Service for operational or technical reasons. Users will be notified in advance via service announcements or other appropriate means. However, in urgent cases (e.g., legal requirements, security threats), the Company may notify users afterward. Additionally, free content (e.g., free virtual currency, promotional rewards) will not be compensated in the event of service termination.
